These terms cover buying and using Duto, and using this website. They are between you and Duto ("we", "us"), an independent software project based in Texas, United States. Purchases are sold by Stripe acting as merchant of record. By installing Duto or buying a licence, you accept them.
Your licence
Buying Duto buys you a licence to use it, not ownership of the software. The licence is perpetual: the version you bought keeps working, and we cannot switch it off remotely. It covers one Mac, or five Macs on the five-Mac licence, and it is for your own use. You may move it between your own machines by releasing a seat.
You may not:
- share, resell, sublicense or publish your licence key;
- work around the licence check, or help others to;
- decompile or reverse engineer the app, except where the law gives you that right regardless of what this document says.
If a licence key is shared publicly or used far beyond the seats it covers, we may revoke that key. We will contact you first where we reasonably can.
The trial
Duto runs for seven days without a licence. When the trial ends, the app stops creating and editing notes, but your existing notes stay readable and exportable, and always will. Your data is yours whether or not you pay for the software.
Updates
Updates are included with your licence. We are not obliged to release any particular update, to keep supporting versions of macOS that Apple has dropped, or to maintain the app forever. If we ever stop working on Duto, the copy you have keeps running on the machines it is licensed for.
Refunds
If Duto does not do what you expected, write to[email protected] within 30 days of buying and we will refund you. You do not need to justify it. Refunds are issued through Stripe, which sold you the licence, and land back on the card you paid with. This is in addition to any statutory right of withdrawal you have where you live.
What we do not promise
Duto is provided as it is. We have tested it and we use it ourselves, but we cannot promise it will be free of defects, that it will suit a particular purpose, or that it will never lose data. Keep backups of anything you would hate to lose. Your notes live in an ordinary file on your disk, so any normal backup, including Time Machine, covers them.
Where the law allows us to limit our liability, our total liability to you for anything connected with Duto is limited to what you paid for it. Nothing here limits liability for death, personal injury, fraud, or anything else that cannot be limited by law. If you are a consumer, your statutory rights are unaffected by anything in this document.
This website
You may read and link to this site. The name Duto, its logo and its content belong to us. We may change or take down the site at any time.
Changes to these terms
We may update these terms for new versions of the app. Changes do not apply retroactively to a licence you have already bought, except where a change is needed to comply with the law.
Law and disputes
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law rules, and the state and federal courts located in Texas have jurisdiction. If you are a consumer in the EU or the UK, this does not deprive you of the protection of the mandatory rules of the country you live in, and you may bring proceedings in your local courts.
